Class Actions or Cases Seeking Class Action status:

Sonic Automotive: Our attorneys are currently involved in a multi-state proceeding, pending before the American Arbitration Association, in which it is alleged that Sonic Automotive, a publicly traded automobile dealership conglomerate, engaged in unfair and deceptive trade practices by “packing” and “stuffing” various products into a consumer sales or lease transaction.

Hendrick Management Corporation: Our attorneys are currently involved in a case seeking class status pending in the Superior Court Division of Union County, North Carolina, in which it is alleged that Hendrick Management Corporation and its affiliated automobile dealerships engaged in unfair and deceptive trade practices by “packing” and “stuffing” various products into a consumer sales or lease transaction.

Triton PCS/Suncom: In this case, our attorneys are seeking to have a case pending in New Hanover County, North Carolina, certified as a class action on behalf of Suncom subscribers who had a charge for SunCom’s “Detailed Billing” added to their bills without their express consent.

Flue Cured Tobacco Stabilization Corporation: Our attorneys are awaiting preliminary approval of a class action settlement that they have entered into on behalf of thousands of members of a flue cured tobacco cooperative that, if approved, will pay out tens of millions of dollars to tobacco farmers in several states.

Product Liability Cases:

EcoStar/Calisle Companies: Our attorneys are handling cases against this manufacturer of a synthetic slate roofing shingle or shake, known as the “Majestic” series, made from recycled rubber and plastic, which was/is designed to emulate slate and shake roofing products, that is alleged to be defective.

Medtronic Sprint Fidelis Lead Wires: In October 2007, the manufacturer recalled these leads because of defects that could cause serious injury or death. We represent clients who have the leads implanted with their internal heart defibrillators.

Bard/Davol Hernia Mesh Patches: Our attorneys are presently litigating claims on behalf of patients whose mesh hernia patches failed resulting in further injury and surgery. 

AMO Contact Solution:  Our firm currently represents consumers who developed serious eye injuries as a result of using the AMO brand Complete Moisture Plus contact solution.

Diabetes:  We are currently investigating claims of new onset diabetes in consumers as a result of taking certain medications, including Chantix and Zyprexa. 

Zelnorm: Our attorneys are pursuing legal remedies for consumers who have suffered heart attack, stroke or death as a result of using Zelnorm.

Liver Failure:  We are investigating claims of liver failure, jaundice, liver dysfunction and kidney failure after heart surgery and the use of certain antibiotics, mainly Ketek.

Medical Malpractice:

Our attorneys are constantly involved in the active investigation and/or litigation of medical negligence cases involving serious injury or death in such specialties are emergency room medicine; cardiology; oncology; optometry; dentistry and other medical specialties.

Nursing Home Abuse/Negligence:

Our attorneys are likewise active in the investigation and/or litigationof cases involving serious injury or death of nursing home residents.

Prescription Errors:

Our firm represents consumers who have suffered serious injury as a result of pharmacy negligence in filling prescriptions with incorrect medications.

Predatory Lending:

Over the past six (6) years, our attorneys have litigated cases across the United States seeking the recovery of excessive fees and charges on behalf of consumers against lenders and loan pools.

Aviation Crashes:

Our attorneys have successfully handled aviation crash cases, including the case of an experimental seaplane crash off of the coast of North Carolina that killed a local Wilmington hairdresser.

Recent Settlements:

Estate of Jones vs. Rural Hospital in North Carolina: In this case, a 71year old man was involved in a high-speed motor vehicle accident during which he sustained a head injury and was transported to a local, level 3 trauma center. He was discharged without a CT scan being performed, and died the next day from an undetected subdural hematoma. The case settled for a confidential amount.

Estate of Smith vs. ABC Medical Group and Jones: In this case, a 72 year old woman, married to her husband for over 50 years, underwent an elective procedure during which the physician perforated her esophagus. After calls were made to the medical group, complaining of excessive pain, the patient’s condition was ultimately discovered at an urgent care center, after which she was transported to the hospital, and died 13 days later from sepsis. The case settled for a confidential amount.
